Relating to the Sale of Used Vehicles:

A 1995 Anchorage judge's ruling clarified several important rules that apply when an Alaska car dealer sells a used car to a retail customer. The Attorney General's Office wishes to work with the used car industry to maintain a good level of cooperation and understanding about the law that applies to used car sales. Our goal is to assist the industry and its customers by making sure the law is clearly stated; easily understood; and predictably enforced. This Business Advisory is issued in order make Alaska used car dealers aware of the rulings of the Superior Court Judge.

Relating to Auto Emission Requirements:

The Alaska Attorney General's Office and the Better Business Bureau of Alaska, Inc. remind all persons engaged in the business of selling used cars that Alaska law requires a person in the business of selling used cars for use in the Anchorage or Fairbanks auto emission inspection areas to present -- prior to sale -- to the prospective purchaser, either a current auto emissions I/M Certificate of Inspection, or an I/M certificate of noncompliance.

Relating to Automobile Retail Advertising:

The Attorney General's Office conducted an extensive state Consumer Protection Act review of price comparison advertising by new car dealers in Alaska and other related advertising issues, as well as the applicable laws, regulations and policies of other states regarding these practices. Based upon its review, the Attorney General's Office issued this business advisory.
