Additional Homicide Charge Not Warranted Against Jerry Active

The Anchorage District Attorney’s Office has completed its review of the autopsy report of 91 year old Y.S. The State Medical Examiner’s Office determined that cause of death for Y.S. was a stroke and the manner of death was natural. Based on this review, the District Attorney’s Office will not seek an indictment for any charges based on Y.S.’s death.
Mr. Active was indicted on June 3, 2013 on ten felony charges, including two counts of murder in the first degree and two counts of murder in the second degree. The June 3 indictment included a charge for the sexual assault of Y.S.
If convicted of murder in the first degree, Mr. Active faces a sentence of up to 99 years in prison. If convicted of sexual assault in the first degree, Mr. Active faces a presumptive sentence of another 40 to 60 years. The sentence is determined by the court and is based on the court’s determination of the seriousness of the crimes and the defendant’s criminal history, among other factors.
The indictment is only a charge and is not evidence of guilt. A defendant is presumed innocent and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.
